The suspension of fundamental rights during emergencies in the Indian Constitution was inspired by the Weimar Constitution of Germany. The idea was borrowed from the German Constitution, which allowed for the suspension of fundamental rights during a state of emergency. The relevant provisions can be found in Article 359 of the Indian Constitution, which grants the President the power to suspend the enforcement of certain fundamental rights during a national emergency.
